China’s Ministry of Commerce and Ministry of Science and Technology have proposed adding 23 artificial intelligence technologies to the national export control list as part of a broader 40-item draft package. The rules target advanced innovations including large language models exceeding performance thresholds, autonomous agents, computing clusters, and hardware designs below 14 nanometers. For the first time, Beijing is seeking to directly regulate the overseas transfer of foundational software assets, such as model weights and source code, rather than just physical semiconductors. While standard API, app, and web access will remain exempt for foreign users, the new framework divides technologies into prohibited and restricted categories. An interim pre-export registration requirement has already taken effect, with public consultations on the draft running through November 15, 2026.
